NB. Debe constar que ambos derechos, el de la propiedad intelectual y el de la propiedad industrial, son indisolubles y colectivos para los indígenas. Por ello, cualquier intento de impementarlos por separado debe tener en cuenta, al menos, la bibliografía del otro campo.
Por lo demás, en esta somera biliografía no se incluyen:
a. Como hemos dicho, los abundantes textos -mucho más frecuentes que los textos sobre derechos de propiedad intelectual-, sobre los derechos colectivos de los indígenas y, en especial, sobre sus derechos colectivos de propiedad industrial -que tienen una notoria incidencia en los campos de la agricultura, la biotecnología y la biodiversidad y de los cuáles hay amplia normativa en FAO, UPOV y OMC-.
b. Los numerosos documentos auxiliares producidos por la ONU y sus agencias especializadas -sobre todo, claro está, la WIPO/OMPI y, en menor medida, la UNESCO. Se hace una excepción con un curso general publicado por WIPO/OMPI.
c. Las normativas positivas nacionales e internacionales (OMPI, UNESCO: 1985 y 1989) y las normativas ideales nacionales e internacionales (leyes-tipo, contratos-tipo, Model Provisions, etc.)
d. Las demandas, querellas y procesos (sentenciados y sub judice) con respecto a este tema.
e. trabajos de divulgación y/ó de síntesis de los títulos anteriores ó basados solamente en ellos ó en otros y no en alguna suerte de investigación primaria.
f. trabajos sobre el interior de las economías indígenas y sobre las relaciones económicas y comerciales entre éstas y la economía mundial.
Otrosí,
1. Algunos de los títulos reseñados forman parte de series anuales de instituciones gubernativas. Se han mencionado, más bien a título de ejemplo y como orientación sobre las fuentes de investigación, cotejo y referencia procesal, aquellas que rozan el tema de esta bibliografía. Por ejemplo: las de USOTA, GAO, etc.
2. A pesar de lo confuso y poco apropiado del término, se han incluido referencias a la defensa del folklore por ser este término el consagrado por el uso en los organismos internacionales y por ser el más cercano a la temática de los derechos colectivos de propiedad intelectual indígena.
3. El mismo término de derechos de propiedad -sea intelectual, sea industrial- es contestado en medios indigenistas sobre la argumentación de que el concepto mismo de propiedad difiere según las culturas. En puridad, el término alternativo propuesto por los expertos es el de derecho a los recursos tradicionales (traditional resource rights, TRR). Las razones para evitar el término 'propiedad' residen en que, para muchos indígenas, la propiedad tiene manifestaciones espirituales e intangibles y, aunque merecedora de protección, no puede adscribirse (pertenecer) a ningún humano.
4. El centro especializado más activo y que centraliza los últimos avances teórico-legales y experiencias en este tema -aunque con especial dedicación a los derechos relacionados con la etnobiología- es el:
